TERMS AND CONDITIONS

1. SCOPE OF APPLICATION

This online store is operated by PHK srl Via Bricherasio 7 – 10128 Torino, Italy.

All orders placed through the online store and contracts entered into with PHK are subject to these General Terms and Conditions (GTC).

2. CONCLUSION OF CONTRACT

By placing products in the shopping cart and selecting the “Order and Pay” button, the customer agrees to enter into a purchase contract with PHK. The contract comes into effect when PHK confirms in writing to the customer that the purchase order has been accepted or the products have been shipped (with an e-mail confirming the order or shipment). Once the order is accepted, the customer is bound to the contract and can no longer make any unilateral changes.

Products and prices presented on a website are not intended as proposals to enter into a contract, but as an encouragement to purchase products.

PHK reserves the right to refuse, in whole or in part, the execution of sales contracts concluded without providing any reasons. In such cases, the customer will be refunded any payment already made. The customer shall have no claims against PHK.

PHK does not accept orders by telephone, e-mail, etc.

3. PRICES AND SHIPPING

Prices are in Euros, VAT included. The applicable price is the one indicated at the time of confirmation of the purchase order.

Shipping costs will be invoiced to the customer in addition to the purchase price of the products ordered.
Type of delivery: DELIVERY DAP: The seller is responsible for the delivery of the goods to the place of destination indicated by the buyer. Costs for the completion of all necessary import formalities are expressly excluded; these shall always be borne by the buyer.
Consequently, all import taxes in the country of destination must be paid by the buyer.

4. DELIVERY TERMS

PHK will send the customer an order confirmation indicating the availability of the ordered products via email. In principle, the customer will receive the ordered products within ten days of the aforementioned email order confirmation.

5. RIGHT OF WITHDRAWAL

The customer has the right to withdraw from the purchase contract concluded with PHK. The right of withdrawal is applicable as long as the products are delivered within 14 days to a delivery service for return to PHK.

For returned products, the customer will receive a refund of the purchase price. Refund of the purchase price is guaranteed as long as PHK receives the product in ideal condition, i.e. complete with all accessories, labels and manuals, unused and undamaged at the following address:

6. FACTORY DEFECTS, WARRANTY AND MANUFACTURER’S WARRANTY

In the case of home shipment, if the package has visible damage, the customer must make sure to accept the goods with reservation.

Immediately thereafter, the customer must check the product received. Any shortages or defects must be reported immediately after their discovery to PHKto make the warranty claim. The customer’s right to warranty will cease in any case after two years from receipt of the ordered products. PHK may satisfy warranty claims by the customer through a replacement, free repair, or a full or partial refund of the purchase price.

7. METHODS OF PAYMENT

In principle, this online store offers the following payment methods to the customer: Bank Transfer, Credit Card (Visa and Mastercard) and Paypal. PHK may decide at its discretion which payment methods to accept.

BANK TRANSFER

You will be contacted with the details to make the payment.

CREDIT CARD

The customer’s credit card account is charged when the order is purchased.

PAYPAL

The customer has the option to pay for the order with PayPal. In case of purchase with Paypal, the customer will be redirected to the Paypal site, where you need to log in with your account or open a new Paypal account.

8. APPLICABLE LAW AND JURISDICTION

All purchase contracts entered into between the customer and PHK are subject to the laws of Italy, excluding the rules of private international law that refer to foreign law. The Vienna Convention on Contracts for the International Sale of Goods (“CISG”) does not apply.

The Court of Turin shall have exclusive jurisdiction over any dispute dependent on this contract.
